Avoiding Payment for a Speeding Ticket

Question:

If someone got a speeding ticket and their parents didn’t pay it off, but instead they paid a lawyer to take if off their child’s record, which is illegal. Do the parents still have to pay for the speeding ticket? Or does the person who received the speeding ticket have to pay it off?

Answer:

In the name of Allah, Most Compassionate, Most Merciful,

If the child has not, as yet, reached puberty and he does not have wealth of his own, then the parents are responsible to pay for the speeding ticket on behalf of their child. Paying a lawyer to remove it from the records is impermissible, thus this remains a debt which they must pay off.

However, if the child has reached puberty, then he himself is responsible to pay for the speeding ticket. Had his parents paid for him, it would have been sufficient, but his parents not paying for the offence will necessitate that he pays for it himself.

The offender who committed the crime must pay for his own doings, for Allah Most High says:

“No bearer of burdens will bear the burden of another.” (Surah al-Isra, V. 15)
